Acceptance of Terms

By accessing and using It's GIF not JIF ("the Platform", "we", "us", "our"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

User Conduct and Responsibilities

Acceptable Use

• Uploading and sharing any files or content that you have the right to distribute.
• Sharing any files that are of public interest, for educational purposes, or for personal, non-commercial expression.

Non Acceptable Use

• Intellectual Property Infringement: Uploading, posting, or sharing any files or content that you do not own or for which you do not have the express permission or license from the copyright holder.
• Spam and Malicious Content: Uploading files that are repetitive, or part of a spam campaign. You may not upload content containing viruses, malware, trojans, or any other code designed to disrupt, damage, or limit the functionality of any computer software or hardware.
• System Abuse: Attempting to interfere with the proper working of the platform, including using automated scripts (bots) for bulk uploading, attempting to bypass our security measures, or placing an unreasonable load on our infrastructure.
• Graphic, Violent, or Obscene Content: Uploading content that is excessively violent, gory, or sexually explicit. This includes content depicting self-harm, suicide, or extreme acts of violence.
• Harassment and Bullying: Uploading content that targets, threatens, bullies, defames, or harasses any individual or group. This includes doxxing (publishing private information about an individual without their consent), non-consensual intimate imagery (revenge porn), or content intended to incite hatred or violence.
• Hate Speech and Discrimination: Posting content that promotes discrimination, bigotry, racism, or hatred against any individual or group based on their race, ethnicity, religion, gender identity, sexual orientation, disability, or any other protected characteristic.
• Our platform maintains an absolute and unconditional zero-tolerance policy for Child Sexual Abuse Material (CSAM). The uploading, sharing, or distribution of any content depicting, suggesting, or relating to the sexual abuse or exploitation of minors is a serious crime and a profound violation of our terms. Any account associated with such activity will be immediately and permanently terminated without notice. We will report all instances of CSAM, along with any associated user data, directly to law enforcement authorities, including the National Center for Missing & Exploited Children (NCMEC), and will fully cooperate with any subsequent investigations.

Rights You Grant to Us

When you upload content to our platform, you retain ownership of your intellectual property rights. However, to operate and provide our services, you grant us a worldwide, perpetual, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify (e.g., to create thumbnails or reformat for display), publish, publicly display, and distribute such content. This license is for the limited purpose of operating, promoting, and improving our services.

Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING:

• Accuracy, completeness, or reliability of information
• Uninterrupted or error-free operation
• Security from unauthorized access or data breaches
• Compatibility with your devices or expectations

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

• Technical failures, data loss, or platform downtime
• Actions of other users or third parties
• Any indirect, incidental, special, consequential, or punitive damages

We reserve the right, but not the obligation, to monitor and review all content submitted to the platform. We may remove any content or terminate a user's access at any time, for any reason or no reason, without prior notice and at our sole discretion, if we believe it violates these Terms of Use or is otherwise harmful to our community or platform.
